GNYADA Crafting Credit Card Surcharge Proposal
/On Tuesday, GNYADA had a positive discussion with a senior member of the NYS Attorney General’s Office about credit card surcharges. During the meeting, GNYADA requested guidance from the NYS Attorney General on how dealers can recoup the costs associated with credit card transactions.
The Attorney General restricts businesses from adding a surcharge when customers pay by credit card except under very limited circumstances, such as gas stations that post prices for both cash and credit card uses.
GNYADA has insisted that while posting prices for both cash and credit card use works for some businesses, dealers are uniquely situated because they sell countless services and products making it impossible to meet the existing requirements set by the AG. As a matter of practicality, dealers cannot maintain and continuously update a traditional posting that lists the cash and credit card prices for every service and part they offer.
In response to GNYADA’s request, the AG’s office asked the Association to provide a detailed proposal and illustrations demonstrating how dealers could inform customers about cash and credit card price differentials. The Association has been addressing this issue with the AG's office for over a year and is optimistic that a resolution can be met. GNYADA began preparing a proposal for submission to the Attorney General.
