New York Adopts No Mask Rule for Some Outdoor Activities for Vaccinated Individuals
/GNYADA has received inquiries relating to the news from the CDC about not wearing masks outside. As the CDC continues to relax some requirements in the fight against the spread of COVID-19, New York has not yet rolled back requirements on businesses. Dealers must continue to follow their specific Safety Plans which include the use of masks for employees.
The guidance issued by the CDC earlier this week and adopted by New York addresses outdoor activities that can be performed by fully vaccinated individuals without face coverings. They also mention a few activities that can take place outdoors without a mask by individuals who have not yet been fully vaccinated. The guidance does not address any changes for businesses.
In the Interim Guidance for Vehicle Sales, Leases, and Rentals During the COVID-19 Public Health Emergency, dealers agreed to follow the rules that state: “Employees must wear acceptable face coverings any time they interact with customers and any time employees are within six feet of another person.” The rules also require a face mask for any employee who participates in a test drive.
However, if your employees are fully vaccinated and enjoying a break outside, they may do so without a face covering. Below is a chart produced by the CDC listing activities that may take place without a face covering for those who are fully vaccinated and those activities that are less safe for those not yet vaccinated which would require a face covering.

What should dealers do now?
Dealers should continue to follow their Safety Plans and ensure employees continue to wear face coverings in accordance with the Plan.
