/Snow Removal Responsibilities
Dealers are reminded to be aware of local code requirements concerning snow removal. In many jurisdictions snow removal from sidewalks and around fire hydrants is the responsibility of the property owner, lessee, tenant, or occupant.
In New York City, dealers must take the following steps to be in compliance:
If the snow stops falling between:
7:00 a.m. and 4:49 p.m. -
you must clear within four hours5:00 p.m. and 8:59 p.m. -
you must clear within fourteen hours Example: If the snow stops falling at 7:00 p.m., the owner, lessee, tenant, occupant or other person in charge of any lot or building has until 9:00 a.m. the following morning to clear.9:00 p.m. and 6:59 a.m. -
you must clear by 11:00 a.m. the next day
Cover sidewalks with ashes, sand, sawdust, or similar suitable material within the same time limits if the snow or ice is too hard to remove.
Do Not throw snow from your property into the street.
Businesses must clear snow and ice from fire hydrants so that emergency services can access them.
City businesses who do not comply can face fines of:
$100- $150 1st Offense
$150- $350 2nd Offense
$250- $350 3rd Offense and subsequent

Severe Weather Closings
Payment of Wages
With the heavy snow falling, Dealers should alert employees about dealership policies during severe weather.
Below is a description of rules for paying your employees if you must close your dealership or if you have a delayed opening.
Hourly employees
If employees are notified in advance that the dealership will be closed, dealers do not need to pay them. Dealers can allow employees to use their accrued time off to be paid.
If the dealership closes but does not let employees know in time, dealers must pay any employees who report to work for at least four hours (or the minimum number of hours in the shift, whichever is less) at minimum wage.
If the dealership closes early, hourly employees must be paid for the actual hours worked or at least four hours at the minimum wage, whichever is greater.
If an employee decides to stay home and the dealership is open, any time taken off due to the poor weather conditions is unpaid or may be taken as a vacation, sick or personal day.
Salaried employees
If the dealership doesn’t open, these employees need to be paid their full salary.
If the dealership is open and the salaried employee decides to stay home, the dealer may require them to use accrued leave. A dealer cannot dock an employee for partial day absences, even if they work only half a day.
Dealers with union contracts must abide by the Severe Weather policies in the CBA.
