Gov. Hochul Requires HERO Act - Dealers Must have Plans in Place
/On Monday, Gov. Kathy Huchul activated the safety plans required by the HERO Act. Private businesses statewide must now implement their plans to prevent the spread of contagious airborne disease, which they were required to adopt by August 5.
"While we continue to increase our vaccination numbers, the fight against the Delta variant is not over, and we have to do everything we can to protect our workers," Governor Hochul said in statement released announcing her decision to activate the law. "This designation will ensure protections are in place to keep our workers safe and support our efforts to combat the virus and promote health and safety."
All businesses, including New Car Dealers, are required to implement a plan to safeguard employees and contractors. In July, the NYS Dept. of Labor released a model plan that businesses could adopt, or alternatively, businesses may draft their own plans so long as they are more protective than the state model document.
The model plan contains measures designed to protect employees, which largely mirrors the NY FORWARD guidance the state released in summer 2020.
The following are protections that dealer must implement:
Mandatory face mask policies “to the greatest extent possible”
Social distancing that includes limiting occupancy, signage, and remote working
Providing employees with PPE
Polices mandating handwashing
Stay-at-home policies for employees with any symptoms of infectious disease
Screening employees at the beginning of their workday for symptoms of COVID-19.
