U.S. Supreme Court Says NO to OSHA Vax or Test Mandate

The U.S. Supreme Court has stopped the Emergency Temporary Standard (ETS) that required businesses with 100 or more employees to mandate that workers are either vaccinated or tested weekly for COVID-19.

This means that OSHA will not be enforcing the ETS and it is no longer necessary for dealers to make any efforts to comply with its requirements.

This decision does not affect state and local COVID mandates that are currently in place.

Specifically, New York dealers must continue to follow the rules below to help prevent the spread of COVID-19 in the workplace:

  • NYS Hero Act Safety Plan
    All dealers should have a Safety Plan in place and ensure that staff is complying with the Plan requirements.

  • NYS Mask Mandate
    This mandate, effective December 13, 2021, requires face coverings for everyone in indoor public spaces through February 1, 2022 unless extended by the Governor.

  • New York City Vaccine Mandate
    Every employee of NYC dealers are required to be fully vaccinated by December 27, 2021 or are to be denied entry to the dealership. There are limited exceptions for medical or religious accommodations, which can be found here.
