NEXT Threat to Dealer Franchise Law: OEM Plans for EV Sales

Download the slides

As dealers, it seems like we are always asking the same question - "What will manufacturers try next that could disregard existing New York Franchise Laws?"  As dealers operations pick-up after the State shut-down from COVID-19, now is a good time to look ahead at strategies manufacturers may be planning that could negatively impact how your dealership operates in the future.

Increasingly restrictive emissions and fuel-efficiency regulations are compelling carmakers to roll out vehicles more able to fit those standards. Accordingly, manufacturers have advertised a whirlwind of plans and timelines for bringing more EVs to market. The approach OEMs take to do that could have an enormous effect on franchise new car dealers.

During this week's webinar, Franchise Law expert, Richard Sox, of Bass Sox Mercer will discuss the various ways OEMs are planning to distribute electric vehicles, proposed agreements they are trying to make with dealers, and how dealers should respond.

Topics to be discussed:

  • The various ways the OEMs are proposing to distribute electric vehicles;

  • Agreements presented to dealers for electric vehicles sales;

  • New York law relating to the distribution of electric vehicles;

  • New York dealers’ rights under the Franchise Law; and

  • Strategies for dealers to respond to OEMs proposed participation agreements.
